JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Sonbarsa P.S.Case No. 79 of 2015 registered under Section 409 of the Indian Penal Code.

The accusation is that one Nagendra Roy and this petitioner being the Chairman and Member of the PACS, Purandaha Rajwara issued cheque in respect to Rs. 2,36,062.62/- but the same was not deposited to the Bank. By that time interest was accrued. The said amount has been defalcated by this petitioner and Nagendra Roy.

Submission is that, in fact, the petitioner being the member of PACS has also put his signature on the cheque. Further

Patna High Court Cr.Misc. No.17664 of 2016 (2) dt.28-04-2016 2/2 submission is that Nagendra Roy has already been allowed bail by a bench of this Court in Cr. Misc. No.49645 of 2015 on 14.12.2015 and the petitioner is in custody since 12.2.2016. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sitamarhi in connection with Sonbarsa P.S.Case No. 79 of 2015.
