Petitioner seeks bail in a case registered under sections 302/34 of the Indian Penal Code.
Prosecution case in short is that on 04.04.2014 the brother of the informant was going to take tea. On the way he saw quarrel between the two parties. He further alleged that when his brother tried to pacify the matter, during the court of intervention all the accused persons including the petitioner assaulted him by lathi, danda, fists and slaps due to which he succumbed to the injuries.
It is submitted on behalf of the petitioner that petitioner is in custody since 02.05.2015. Attention of this court
Patna High Court Cr.Misc. No.27502 of 2015 (2) dt.31-07-2015 2/2 has been drawn to annexure-2 which is the postmortem report. As per the postmortem report it appears that there is no external injury on the body of the deceased but as per the first information report there is allegation of assault against accused persons. On behalf of the State and the informant it is submitted that petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Abhishekh Kunal, J.M. Ist class, Gopalganj in Fulwariya P.S. Case No. 41 of 2015. (Sudhir Singh, J) M.Rahman/- U T
