2. The petitioner seeks bail in a case registered for the offence punishable under Sections-304(1), 3(5), 62 B.N.S. & 25(1-B)a, 26, 35 of the Arms Act.
3. It is alleged that on the tip off, the informant along with other police officials reached at the place of occurrence and apprehended the petitioner from whose possession, one motorcycle without registration number and one country made pistol are said to have been recovered.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. He was not arrested rather the mob handed over the
Patna High Court CR. MISC. No.5413 of 2025(2) dt.19-02-2025 2/2 petitioner to the police. He is under custody since 15-07-2024.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 373 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
