The petitioner seeks regular bail in connection with Jadiya P.S. Case No. 141 of 2019 instituted for the offences punishable under Sections 450, 341, 342, 326, 307, 302, 120(B) and 34 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. It has been submitted by the learned counsel for the petitioner that petitioner is neither named in the F.I.R. nor put on Test Identification Parade (T.I.P). The name of the petitioner has surfaced in this case on the basis of confessional statement of one co-accused namely, Anil Sah before police. Further, it is submitted by the learned counsel for the petitioner that similarly situated three accused persons, including Anil Sah on whose confessional statement the petitioner was made accused in this case, have been granted bail by this Hon'ble Court. It is submitted that co-accused namely, Anil Sah has been granted bail by this Hon'ble Court vide Cr. Misc. No. 5852 of 2020 order dated 01.06.2020 and other two accused whose details are mentioned in paragraph 10 of the bail application. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 20.11.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two
