====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 11-08-2021 Heard learned counsel for the parties through video conferencing.

The petitioner has preferred this application for grant of regular bail in a case registered under section 436 and other sections of the Indian Penal Code, sections 3 and 4 of the Explosive Substance Act and sections 13, 16, 18, 19, 20 and 38 of the U.A.P.A. Act.

As per allegations in the F.I.R., a group of accused persons belonging to a naxalite group are stated to have attacked the M.W Sawkala plant at Gaya taking the employees as hostage on gun point.

It is submitted by learned counsel for the petitioner that the material that has transpired in course of investigation has been dealt with by the learned Court below as also in the

Patna High Court CR. MISC. No.15796 of 2021(2) dt.11-08-2021 2/2 orders brought on record as Annexure-2 series to the petition whereby the co-accused, Surendra Yadav and Munna Ramani, have been granted bail. The case was registered against 40 unknown and the name of this petitioner transpired in the confessional statement of a co-accused made before police. No incriminating article has been recovered from her possession. She is in custody since 6.11.2019 and has no criminal antecedent. Investigation in the case has concluded. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody together with the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Amas P.S. 196 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
