JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-08-2022 At the outset, learned counsel for petitioners seeks permission to withdraw the anticipatory bail application of Jay Ram Singh @ Jairam Choudhary petitioner no. 1. Permission is granted. Anticipatory bail application with regard to Jay Ram Singh @ Jairam Choudhary is dismissed as withdrawn.
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Sasaram (Muffasil) P.S. Case No. 188 of 2021, registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code.
As per the prosecution case, on the alleged date and

No.5694 of 2022(2) dt.01-08-2022 2/2 time of occurrence while the informant along with other police officials had gone to conduct raid against illegal mining and transportation of sand, petitioners are alleged to have pelted stones on the police party and also succeeded in fleeing away with two trucks which were seized by the police. Petitioner has been identified by the local Choukidar.
It is submitted that allegation is general and omnibus. Petitioner is neither driver nor owner of vehicles in question. Petitioner has been made accused in this case merely on suspicion. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 188 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
