JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 The petitioners apprehend their arrest in connection with Muffasil P.S.Case No. 206 of 2018 registered under Sections 323, 354,384,452,504 and 506/34 of the Indian penal Code. Allegation against the petitioners, as per Complaint petition is that complainant is residing with her husband over two decimals of land allotted financial assistance under Indira Awas Yojana for construction of house and she collected household materials for construction of the same however petitioners came and demanded Rs. 50,000/- as Rangadari for construction work and also assaulted husband of the complainant.
Submission of learned counsel for the petitioners is that

No. 5224 of 2019(3) dt.13-03-2019 2/2 petitioners have stated on oath in para-7 of the petition that adjacent plot is of father of the petitioner no. 1 and complainant has collected material over that land which was objected by the petitioners and others as such the present false case has been lodged.
Heard learned APP also and learned counsel for the informant, they have opposed the prayer for anticipatory bail on the ground that witnesses have also supported the allegation. Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Katihar in connection with Mufassil P.S. Case No. 206 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
