Petitioner seeks bail in a case registered under sections 420, 414 and 120B of the Indian Penal Code.

The alleged recovery is said to have been made from godown of one Dinesh Chaudhary and the petitioner was, allegedly, caught on the spot. The above stated co- accused Dinesh Chaudhary disclosed that seized articles had been brought by the petitioner but admittedly, one truck was also seized by the informant from the place of occurrence and it is the case of the prosecution that seized articles had been brought on the above stated truck.

Petitioner neither happens to be owner nor driver of the said truck.

Moreover, petitioner is in jail custody since 17.1.2016 and only one case Bhagwanpur P.S. case no. 159/2015 for the offences

Patna High Court Cr.Misc. No.19155 of 2016 (2) dt.05-05-2016 under sections 341, 323, 504/34, 379 of the Indian Penal Code had been registered against the petitioner prior to institution of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate III, Vaishali at Hajipur in Bhagwanpur P.S. Case no. 12/2016. shahid (Hemant Kumar Srivastava,J) U T
