2. In this case, the petitioner is seeking regular bail in connection with Mufassil P.S. Case No. 167 of 2024, registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.
3. As per allegation, one country-made pistol and four live cartridges were recovered beneath the pillow of the petitioner.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from his
Patna High Court CR. MISC. No.6170 of 2025(2) dt.28-02-2025 2/2 possession. He is under custody since 07.05.2024. He has also submitted the the bail petition of the petitioner was earlier rejected by this Court vide order dated 05.09.2024 in Cr. Misc. No. 61728 of 2024 considering the fact that he was an accused also in Mufassil P.S. Case No. 109 of 2024, registered under Section 302/34 of the IPC but the petitioner, after being arrested in the present case, was remanded in that case and he has been granted bail in that case by the court below itself.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Samastipur in connection with Mufassil P.S. Case No. 167 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
