Petitioner seeks bail in a case registered under sections302, 201/34 of the Indian Penal Code. According to the F.I.R. the informant got an information that a dead body of a man aged about 45 years has been thrown beside of road near Kulhariya Railway Gumati. On getting such information informant went there and found the dead body. From the dead body it was evident that some one has committed murder and has thrown the dead body besides the road. On behalf of the petitioner it is submitted that the petitioner is in custody since 31.07.2014 and charge sheet in the case has been submitted. It is further submitted that

Patna High Court Cr.Misc. No.27531 of 2015 (2) dt.31-07-2015 2/2 petitioner is not named in the first information report. There is no direct evidence against the petitioner.

On behalf of the State and the informant it is submitted that petitioner's name has come during the course of investigation. It is further submitted that the trial is in progress and five witnesses have been examined in the case. Prayer for bail of other accused persons have already been rejected vides Cri. Misc. No.1339/15 and Cri. Misc. No. 643/15.

Considering the aforesaid facts, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected. Any how the trial court is directed to take all necessary steps for procuring the attendance of witnesses and conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order. .
