The petitioner seeks bail in connection with Harnaut P.S. Case No. 445 of 2015 registered under Sections 399 and 402 of the Indian Penal Code and also Sections 25(1-B)(a), 26 and 35 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the petitioner was neither caught on the spot nor any incriminating article was recovered from his possession. Apart from confessional statement of co-accused who has already been granted bail by this Court in Cr. Misc. No.13517 of 2016 on 25.4.2016, there is no other material to connect the petitioner with

Patna High Court Cr.Misc. No.21760 of 2016 (2) dt.20-05-2016 2/2 the present case.

Regard being had to the facts and circumstances of the case, the petitioner, namely, Ashok Yadav @ Ashok Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No.445 of 2015.
