JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 155 of 2018, corresponding to G.R.No.6894 of 2018, registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner is of demand of Rs.5 lacs and for that he has subjected the informant to cruelty and harassment.

On appearance of opposite party No.2 the matter was referred to the Mediation Centre vide order dated 4.4.2019 and the Mediator's report at Flag 'X' disclosed that the dispute between the parties has been resolved through the process of

No.7314 of 2019(6) dt.15-07-2019 2/3 mediation as per terms and conditions mutually agreed upon by both the parties and learned counsel for the petitioner has handed over a Bank Draft to learned counsel for opposite party No.2, who in turn has handed over to the opposite party No.2 in Court itself.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna, in connection with Mahila P.S. Case No. 155 of 2018, corresponding to G.R.No. 6894 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to obey the terms and conditions as mutually agreed upon between the parties and it is expected that opposite party No.2 shall also abide by the terms and conditions of settlement mutually arrived at between the parties.
