The petitioners seek bail in connection with Warisnagar P.S. Case No. 238 of 2021 (P.T. No. 377 of 2021) instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 09.09.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that the allegation is of recovery of 153 litres of liquor from a Scorpio

Learned counsel for the petitioners submits that the petitioner no. 1 is the driver of the truck and as such was not aware what the owner had kept in the truck and petitioner no.2 was a co-villager who was accompanying the petitioner no.1 and as such was not knowing what was kept in the truck. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise, Samastipur in connection with Warisnagar P.S.
