The petitioner seeks bail in Sessions Trial No. 569 of 2014, arising out of Laukariya P.S. Case No. 26 of 2014, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code.
The informant widow of the deceased made very specific allegation that the petitioner assaulted with spade on the head of her husband causing his death.
It is submitted that the injuries caused by hard and blunt object although allegation against the petitioner is that he assaulted with spade.
Considering the facts aforesaid and the fact that the petitioner assaulted the husband of the informant on head with
Patna High Court Cr.Misc. No.28210 of 2015 (2) dt.05-08-2015 2/2 spade causing his death, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. The petitioner is in jail since 31.03.2014, the trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order, if the trial is not concluded without fault of the petitioner, the petitioner may renew his prayer for bail firstly in the court below.
