The petitioner through the Public Interest Litigation prays for a direction to the respondents authorities in the Panchayati Raj Department to make inquiry into the functioning of the Gram Panchayat as regarding implementation of the schemes under 'Mukhya Mantri Sath Nischay Yojana'. Learned Counsel for the petitioner in reference to the

Patna High Court CWJC No.1169 of 2019(2) dt.21-01-2019 2/3 discussed representation at Annexure-P/1 submits that the representation is filed before the District Panchayat Raj Officer, Muzaffarpur but since the Department has shown a laid back attitude towards the inquiry that the present writ petition is filed. Per contra, Mr. Ajay, learned GA 5 in reference to the orders present at Annexure-P/2 to the writ petition and the subsequent orders has submitted that the action has already been taken on the representation and in case the petitioner is not satisfied, an appropriate action may be issued to the District Panchayat Raj Officer, Muzaffarpur, Respondent no. 5 for expeditious disposal of the representation.

Having heard learned Counsel for the parties and considering that the representation at Annexure-P/1 by the petitioner has been acted upon by the Block Development Officer, since the matter relates to financial irregularities and otherwise in the scheme sought to be implemented under the 'Mukhya Mantri Sath Nischay Yojana' in so far as it relates to Gram Panchayat Raj, Dihuli Ishak of Sakra Block in the District of Muzaffarpur, we deem it proper to direct the District Panchayat Raj Officer, Muzaffarpur, the respondent no. 5 to examine the grievance and take it to its conclusion by a speaking order to be passed within a period of three months

Patna High Court CWJC No.1169 of 2019(2) dt.21-01-2019 3/3 from the date of receipt/production of a copy of this order. With the observation and direction above, the writ petition is disposed of.
