====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-02-2019 Heard learned counsel for the petitioners. No one appears on behalf of the State to oppose the prayer for anticipatory bail.

Petitioners are seeking anticipatory bail in connection with Bairiya P.S. Case No.56 of 2016 registered for the offences punishable under Sections 363, 366 (A) and 494 of the Indian Penal Code.

Learned counsel for the petitioners submits that no case of kidnapping or abduction may be made out in view of the statement of the victim lady under Section 164 Cr.P.C. It is submitted that in her statement the victim lady has categorically stated that she had on her own gone along with these petitioners. Further these petitioners have got no criminal antecedent.

No.4669 of 2019(2) dt.11-02-2019 2/2 In the given facts and circumstances of the case, taking note of the statements made under Section 164 Cr.P.C statement of the victim lady, this Court is willing to grant the privilege of anticipatory bail to the petitioners, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.15,000/-(rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M, Bettiah, West Champaran in connection with Bairiya P.S. Case No.56 of 2016, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
