Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 323 and 498(A) of the Indian Penal Code, registered in connection with Complaint Case No. 201 of 2016.

The learned counsel for the petitioner has submitted that the marriage of the petitioner was settled with Chandni Kumari, but the family members of the complainant were attempting to solemnize his marriage after impersonating the girl to which he protested. Thereafter he was made captive by the inmates of the complainant Neha Kumari and in this respect

Patna High Court CR. MISC. No.5775 of 2022(2) dt.24-08-2022 2/2 the father of the petitioner lodged Rajoun P.S.Case No. 104 of 2016 against the family members of the complainant. He has submitted further that after recovery the statement of the petitioner was recorded under Section 164 of the Cr.P.C. in which he supported the occurrence.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate Bhagalpur in connection with Complaint Case No. 201 of 2016, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
