2. The petitioner apprehends arrest in a case registered for the offence punishable under section 395 of the Indian Penal Code.

3. As per the prosecution case, accused persons entered the house of the informant pretending to be police men and took away ornaments worth Rs.6 lacs.

4. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR and his name has come in the case during investigation. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.7554 of 2024(2) dt.20-02-2024 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IX, Vaishali at Hajipur in Desari Police Station Case No. 38 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
