The petitioner is accused in connection with Murliganj P.S. Case No. 01 of 2016 registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.
The accusation is that on receiving secret information about gathering of miscreants and making preparation for committing dacoity, the police reached at the house of Badruddin and arrested four persons including the petitioner. On search, the petitioner was found in possession of one country made loaded pistol and one mobile set.
Learned counsel for the petitioner submits that that
Patna High Court Cr.Misc. No.20761 of 2016 (2) dt.17-05-2016 petitioner has no criminal antecedent and is in custody since 31.12.2015. It is further submitted that co-accused, Badruddin, has already been granted privilege of bail by a bench this Court vide order dated 03.05.2016 passed in Criminal Misc. No. 18841 of 2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No. 01 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
