====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-01-2022 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State, through Video Conferencing.
This application, for grant of anticipatory bail, arises out of Pandaul Police Station Case No. 274 of 2020 dated 26.10.2020, corresponding to C.R.I. No. 2197 of 2020, disclosing offences under Sections 448, 341, 323, 307, 354, 379, 504, 506/34 of the Indian Penal Code.
As per allegation, the accused persons named in the FIR including the present petitioner, entered into the house of the informant and badly assaulted him. The further allegation is that they also outraged the modesty of the female family members of the informant and took away Rs. 25,000/- after breaking the lock of Almira.
The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.15101 of 2021(2) dt.13-01-2022 2/2 that there is case and counter case and the members of petitioner's side have also sustained injuries in the free fight. He has further submitted that the allegation against the present petitioner is that he assaulted the informant on his head. The injury report of informant is annexed with the record which shows that all the injuries are simple in nature caused by hard and blunt substances. Learned Addl. P.P. has opposed and the prayer for bail. Considering the aforementioned fact and circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani, in connection with Pandaul Police Station Case No. 274 of 2020, corresponding to C.R.I. No. 2197 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
