The petitioner is apprehending his arrest in connection with Shahpur P.S.Case No.271 of 2018 registered for offences punishable under Sections 147, 148, 149, 353,307, 384 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that in order to establish primacy on the sand lifting, two groups assembled and the police on information raided there and asked them to surrender but instead they started firing on the police party. The petitioner is named in the FIR.
Submission of the learned counsel for the petitioner is that nothing specif has been attributed against the petitioner though he is named in the FIR and another co-accused has been granted bail by a Co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.4484 of 2019(2) dt.29-01-2019 2/2 dated 17.12.2018 passed in Cr. Misc. No.68048 of 2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order and the learned court below shall verify the criminal antecedent of the petitioner and if the petitioner has no criminal antecedent he shall release the petitioner on bail in connection with Shahpur P.S.Case No.271 of 2018 to the his own satisfaction , otherwise he is free to pass any other order or orders as he deems fit and proper.
With the aforesaid observation, this application is disposed of.
