The petitioner has filed this writ petition for quashing the order dated 27.03.2017, as contained in memo No. 2797 (Annexure-12), issued under the signature of Registrar, Cooperative Societies, by which the petitioner has been put under suspension in contemplation of departmental proceeding for certain omission and commission with regard to financial matters, while posted as Executive Officer, Nagar Panchayat, Tekari. The learned counsel for the petitioner, while assailing the order of suspension, submits that the petitioner was posted as Executive Officer, Tekari from 07.09.2015 and irregularities and illegalities were committed in Nagar Panchayat before the joining of the petitioner. The Sub divisional Officer, Gaya held enquiry and submitted report to the Principal Secretary,
Patna High Court CWJC No.11393 of 2017 (2) dt.07-09-2017 2/2 Urban Development Department, Government of Bihar, Patna. I do not find any force in the submission of the learned counsel for the petitioner as it appears from the enquiry report itself that certain omission and commission are alleged to have been committed by the petitioner during his tenure as Executive Officer, Nagar Panchayat, Tekari. Therefore, I do not find any illegality in the order of suspension. This writ petition is, accordingly, dismissed.
