The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant is not an eye witness of the occurrence. Mahesh Yadav is alleged to have taken the brother-in-law of the informant with him but the brother-in-law of the informant became traceless and his dead body was recovered. It is submitted that there is no eye witness of the occurrence. Similarly situated co-accused, namely, Moti Yadav has been granted anticipatory bail in Cr.Misc.No. 8822 of 2015, Sakaldeo Yadav has been granted bail in Cr.Misc.No. 7746 of 2015 and Bhageran Yadav and Ramesh Yadav have already been granted bail.

Patna High Court Cr.Misc. No.19643 of 2015 (2) dt.16-06-2015 Case of the petitioner stands on the similar footing. Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Makhdumpur P.S.Case No. 249/14.
