JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but admittedly, none has scene the actual occurrence and the name of the petitioners surfaced in this case on the basis of suspicion and thereafter, the house of petitioners was searched and allegedly stolen articles were recovered from their house. The contention on behalf of the petitioners is that nothing was recovered from the house of the petitioners and as a matter of fact, petitioners have implicated in this case on account of enmity. It is further submitted on behalf of the petitioners that seizure list does not bear signature of either of the petitioners or their family

Considering the aforesaid facts and circumstances and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Muzaffarpur in connection with Maniyari P.S.Case No. 96 of 2014.
