The petitioner, who is in custody since 25.01.2016, seeks regular bail in connection with Khaira P.S. Case No.252 of 2015, registered for the offence punishable under Section 395 of the Indian Penal Code and Section 25 of the Antiquities and Art Treasures Act, 1972. From the First Information Report, it transpires that the accused persons took away the idol of Lord Mahabira from Janam Asthan Mandir after making the guards their captives. They are also said to have taken
Patna High Court Cr.Misc. No.22977 of 2016 (2) dt.24-05-2016 2/2 away silver crown of the said idol. From the statement of one Anand Kumar, recorded under Section 164 Code of Criminal Procedure, it appears that the petitioner had gone to his shop for selling an old piece of silver. It appears that the said silver piece has been found to be part of the silver crown stolen from the said temple.
Considering the seriousness of the crime, I am not inclined to grant the petitioner, abovenamed, the privilege of regular bail.
This application is, accordingly, rejected.
