JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Kadamkuan P.S. Case No. 279 of 2020, registered for the offences punishable under Sections 25(1-B)A, 26, 27, 35 of Arms Act. As per FIR, on the occasion of the birthday of Ankit Sinha @ Shera, a number of accused persons mentioned in the FIR, were indulged in celebratory firing. On police raid 10 persons were arrested with arms and ammunition described in the FIR. Learned counsel for the petitioner has submitted that the petitioner was not arrested on the spot. He was not indulged in celebratory firing rather he was participating in that birthday party as

Patna High Court CR. MISC. No.15991 of 2021(2) dt.18-01-2022 2/2 a bona fide invitee. The arrested persons have been granted regular bail by the court below. He has also submitted that on similar footing co-accused Shivam Verma, has been granted anticipatory bail in Cr. Misc No. 14643 of 2021 vide order dated 12.01.2022 by this court. Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-12, Sadar, Patna in connection with Kadamkuan P.S. Case No. 279 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
