JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 of the Indian Penal Code and under Sections25(i-B)A/26/35 of the Arms Act. One loaded country-made pistol is said to have been recovered from possession of the petitioner, when petitioner and some others were arrested by the police. The petitioner and his associates disclosed that they had assembled to commit dacoity. The petitioner does not have any criminal antecedent and is languishing in jail custody since 10-09-2015. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.20904 of 2016 (2) dt.19-05-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bakhtiarpur P.S. Case No. 259 of 2015 corresponding to Sessions Trial No. 116 of 2016 to the satisfaction of Learned Additional District & Sessions Judge-Ist, Barh, District-Patna.
