JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 28-07-2015 Learned counsel for the petitioners is permitted to make necessary correction in the petition. Heard learned counsels for the petitioners and the State.

The petitioners are languishing in custody since 30.04.2015 and 03.04.2015 respectively in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The son of the informant Dilip Kumar went missing since 30.10.2014 when he went to watch Chhath festival but he did not return. Subsequently his dead body with injuries was recovered from the railway track. When suspicion was raised

Patna High Court Cr.Misc. No.29747 of 2015 (3) dt.28-07-2015 2/2 against the petitioners since nephew of petitioner no. 1 was killed three years ago and the petitioners used to threat for taking revenge.

It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. Moreover, the accusation has already concluded and co-accused Dinesh Rai has been granted bail vide Cr. Misc. No. 19960 of 2015.

Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 355 of 2014.
