JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 Earlier the prayer for anticipatory bail of the petitioner was permitted to be withdrawn at the instance of the petitioner vide order dated 25.08.2018 passed in Cr. Misc. No. 33583 of 2018.

The petitioner apprehending his arrest in connection with Bariyarpur P.S. Case No. 43 of 2017, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 336, 448, 302 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that later on co-accused Kalabati Devi has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 02.08.2018 passed in Cr. Misc. No.36546 of 2018. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.10070 of 2019(3) dt.06-03-2019 2/2 circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below and make prayer for regular bail, which shall be considered on the basis of materials available on record and also considering the fact that other co-accused person has been granted anticipatory bail by this Court.
