JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Malaypur Police Station Case No. 53 of 2020 registered for the offences punishable under section 392 of the Indian Penal Code. As per the prosecution case, three unknown persons stopped the informant, who is RO of Bandhan bank on gun point and assaulted him. They snatched the banking tab, register, cash of Rs.18700/- and mobile set of the informant. Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused Rajesh Kumar Mandal. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. Petitioner claims clean antecedent and

Learned counsel for the State opposes the prayer for bail and submits that on the confessional statement of coaccused Rajesh Kumar Mandal, banking tab, cash of Rs.400/- and one registrar of the Bandhan Bank have been recovered from the possession of the petitioner.

Considering the fact that the looted articles have been recovered from the possession of the petitioner, his prayer for bail is refused.
