JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Special Case No. 1442 of 2019 arising out of Araria (Bairgachhi) P. S. Case No. 904 of 2019, registered for the offences punishable under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Petitioner is named in the F.I.R. There is recovery of 160 bottles of cough syrup of 100 ml. from the co-accused persons.

Submission of the learned counsel for the petitioner is that except confession, there is nothing against him. Petitioner is in custody since 06.01.2020.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that petitioner is accused in six other cases of similar type.

Patna High Court CR. MISC. No.6476 of 2020(2) dt.04-02-2020 2/2 Having heard both sides, in view of the submissions, made above, and also considering the antecedent of the petitioner, I am not inclined to grant bail to the petitioner at this stage. However, once the charge has been framed in this case, petitioner is at liberty to renew his prayer for bail. With the above observations, this application is dismissed.
