The petitioner is apprehending his arrest in a case registered under Sections 406 and 420 of the Indian Penal Code. Allegation is that the accused persons including the petitioner cheated the informant.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The allegations made in the F.I.R. is denied by the petitioner. No wrongful loss or wrongful gain has been made on the part of the petitioner. No money in question was deposited to the petitioner. It is further submitted that the petitioner is ready

Patna High Court Cr.Misc. No.3887 of 2019(2) dt.29-01-2019 2/2 to deposit an amount of Rs.2 lacs in the court below within a period of twelve weeks, which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs.2 lacs in the court below within a period of twelve weeks, which shall be subject to the final disposal of the case. On doing so, the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of fourteen weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. case No.235 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
