JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 354 and 504/34.

Prosecution case is that on 29.03.2013, the informant along with her husband and children were returning from native village Narayanpur to Patna, In the meantime, 15-20 persons surrounded the vehicle of the informant near Mahddichak temple when husband of the informant came out of the car then all the accused persons started assaulting him. The accused persons including the petitioner also assaulted the informant and snatched her gold chain. The accused persons also assaulted the children of the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.20197 of 2016 (2) dt.09-05-2016 2/2 no injury was caused to the informant a statement to that effect has been made in paragraph 12 of the petition. However, chargesheeted co-accused Bikoo Kumar has been granted anticipatory bail vide Criminal Miscellaneous No.7775/2014 by a co-ordinate Bench of this Court whereas co-accused Rantosh Singh, against whom final form has been submitted has also been granted anticipatory bail vide Criminal Miscellaneous No.39648/2015 by a co-ordinate Bench of this Court. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Danapur, Patna in connection with Bihta P.S. Case No.146/2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
