JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1234 of 2017, corresponding to Trial No. 2673 of 2018, in which cognizance has been taken under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife to mental and physical torture with respect to demand. Submission of learned counsel for the petitioner is that he is still ready to keep his wife with him and learned counsel for the opposite party No.2 has submitted that she is ready to live with the petitioner if she is given dignity and care. It has also been submitted that opposite party No.2 has filed a

Patna High Court Cr.Misc. No.3459 of 2019(3) dt.22-02-2019 2/2 case for maintenance before the Family Court. In such view of the matter, this application is disposed of with a direction to the petitioner to appear before the court below on 12.3.2019 with an application stating that he is ready to keep his wife with him with all dignities and care and opposite party No.2 shall also appear on the same day and on her appearance the petitioner shall be released on provisional bail for a period of four months allowing the petitioner to take opposite party No.2 with him in his house and during that period the court below shall watch the conduct of both parties by calling them in the first week of each month and once the court is satisfied with their conduct the bail bond of the petitioner shall be confirmed by the court below itself, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bond of the petitioner.
