The petitioner is apprehending his arrest in connection with Chakai P.S.Case No.165 of 2017 , registered for offences punishable under 147, 148, 149, 323, 324, 341, 367 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assaulting brutally by Tangi to the informant.

Submission of the learned counsel for the petitioner is that there is case and counter case and moreover injuries are simple in nature, which will appear from Annexure 3. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within

Patna High Court Cr.Misc. No.4496 of 2019(2) dt.29-01-2019 2/2 a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 3rd, Jamui in connection with Chakari P.S.Case No.165 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
