Petitioner is not named in the first information report and the name of this petitioner came in confessional statement of co-accused, Sarvan Yadav. The learned Additional Sessions Judge has discussed almost all the relevant paragraphs of the case diary in his impugned order and it appears from the order of learned Additional Sessions Judge that except confessional statement, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.27451 of 2015 (2) dt.06-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur P.S. Case No. 165 of 2014.
