The petitioner seeks bail in connection with Forbesganj P.S. Case No.662 of 2014 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, it has only come that in the looted mobile, the SIM in the name of the petitioner was being used, and, thereafter, the petitioner was apprehended by the police and police got recorded his confessional statement showing his involvement in the present case. Except that, there is no material to show the involvement of
Patna High Court Cr.Misc. No.19326 of 2016 (2) dt.05-05-2016 2/2 the petitioner in the present case. While the informant has claimed to have identified the culprits on seeing them again but the petitioner has not been put on T.I. Parade. The petitioner is in custody since 09.02.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.662 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
