The petitioner seeks regular bail in registered for the offences punishable under section 364A of the Indian Penal Code.
As per the prosecution case, unknown accused persons demanded Rs.5 lacs from the informant on his phone for release of his father.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. Petitioner's name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the State opposes the prayer for bail and submits that on the statement of the petitioner, the victim was recovered from the house of co-accused Ram Udgar Yadav.
Considering the nature of accusation and materials collected during course of investigation, prayer for bail of the petitioner is refused.
