The petitioner apprehends his arrest in Cheriya Bariyarpur P.S. Case No. 296 of 2022, registered for the offences punishable under Section 120(B) of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act. 70 litres of country made liquor has been recovered from the sugarcane field of one Kunjo Singh.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner has no concern with the seized liquor.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got one criminal antecedent of similar nature.

Patna High Court CR. MISC. No.6128 of 2023(2) dt.10-04-2023 2/2 Taking into consideration the fact that petitioner is having criminal antecedent of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
