Petitioner is accused in connection with Chapra Rail (Rail P.P. Chapra Kachahari) P.S. Case No. 48 of 2015. Case No.48 of 2015 registered under Sections 395/397 of the I.P.C. and later on section 412 of the I.P.C. was added. Submission is that petitioner is not named in the F.I.R. In course of investigation, the Police apprehended the petitioner and got recorded the confessional statement showing the involvement of the petitioner in the present case and also the confessional statement of co-accused Sunil Kumar Gupta has also been recorded having hand of this petitioner in the case. Except that, there is no tangible material to show his presence in the
Patna High Court Cr.Misc. No.19286 of 2016 (2) dt.05-05-2016 2/2 present case. It is further submitted that petitioner is in custody since 05.09.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Saran in connection with Chapra Rail (Rail P.P.
