JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Samastipur Muffasil P.S. Case No. 366 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 201 litres of liquor from the cattle shed of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and he is in custody for three months and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.8682 of 2020(2) dt.28-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur, in connection with Samastipur Mufassil P.S. Case No. 366 of 2019.
