JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and it is alleged that petitioners were caught on the spot. There is accusation that they along with several other accused persons attacked on the informant and other police officials and not only they assaulted the constables but also snatched one loaded rifle from one SAP Jawan. The aforesaid rifle was, later on, recovered from the possession of co-accused Chhotu Kumar. Submission on behalf of the petitioners is that petitioners were caught by the police from their respective homes and, as a matter of fact, they are in jail custody since 03.01.2016 and no specific overt act has been attributed against them. Petitioners do not have any criminal antecedent.

Patna High Court Cr.Misc. No.20126 of 2016 (2) dt.09-05-2016 2/2 Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Gaya in connection with Buniyadganj P.S.Case No. 02 of 2016.
