2. The petitioner seeks regular bail in the present case registered for the offence under Sections 8/20(b)(ii)A & 8(c)/21(b) of the NDPS Act.

3. 100 grams of hashish, 20 grams of heroine and a digital weighing machine have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 13.11.2024 and claims clean antecedent. He further submits that the recovery of hashish is of small quantity and recovery of heroin is of intermediate quantity.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the recovery of hasish which is of small quantity and the recovery of heroine which is of intermediate quantity, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned District and Sessions JudgeAraria/concerned Court below in connection with Bathnaha P.S. Case No. 120 of 2024 subject to condition that:- (i). Before accepting the bailbonds of the petitioner, the Court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, then the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), then his bail-bonds shall not be accepted by the court below.
