JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-02-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel for the University.

The grievance of the petitioner relates to payment of arrears of difference of salary from 01.01.1996 to 31.07.2005. The revised pay scale was admissible in terms of the recommendation of the University Grants Commission but the arrears of salary has not been paid to the petitioner. Considering the aforesaid, the authority of the University is directed to pay the arrears of difference of salary

Patna High Court CWJC No.3096 of 2020(2) dt.24-02-2020 2/2 from 01.01.1996 to 31.07.2005 after proper scrutiny and ensure payment of arrears of difference of salary in the revised pay scale to the petitioner at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order.

It goes without saying that in the event the authority of the University needs additional fund and the University raises demand, the State Government shall provide the fund thereafter the University shall redress the grievance of the petitioner as to payment of arrears of difference of revised salary. With the aforesaid, the present writ petition stands disposed of.
