JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-06-2016 There happens to be some sort of discrepancy relating to PS as scribed Hilsu in place of Hisua under the prescribed form attached with the main petition. However, learned counsel for the petitioner has submitted to ignore the same as according to learned counsel for the petitioner the case relates to Hisua and not of Hilsu.
At the submission of learned counsel for the petitioner, the aforesaid defect is being ignored. Heard learned counsel for the petitioner as well as learned APP for the State.
Informant, Sihanta Devi who is not an eyewitness to the occurrence, had alleged that petitioner might have enticed away her daughter, Shilpi Kumari aged about 13 years as he was tutor at an earlier occasion. From the order impugned as well as
Patna High Court Cr.Misc. No.22320 of 2016 (3) dt.13-06-2016 from Annexure-2, statement of victim Shilpi Kumari recorded under Section 164 Cr.P.C, it is evident that she had not pin pointed the petitioner to be her abductor.
That being so, petitioner, Pankaj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Hisua PS Case No.36 of 2016.
