1. Heard the learned counsel for the petitioners and the learned APP for the State.

2. The petitioners apprehend their arrest in connection with Bagaha Cyber P.S. Case No.16/2023 registered for the offence punishable under Sections 498(A), 385, 376, 354©, 354(D) and 34 of the Indian Penal Code & Sections 3⁄4 of the D.P. Act and Sections 66, 67 and 67(A) of the I.T. Act.

3. Learned counsel for the petitioners submits that petitioners are an unmarried sister and father of Azad Ansari and are persons with clean antecedent. It is next submitted that the informant alleges that she was in love with Azad Ansari and they developed intimate relationship. Thereafter Azad Ansari

No.10131 of 2024(2) dt.29-02-2024 2/3 also took her intimate photographs and established physical relation but when she approached for marriage, it is alleged that Azad along with his family members including the petitioners demanded dowry. The learned counsel submits that from bare perusal of the photographs annexed with the F.I.R, it would manifest that the informant and Azad were in a relationship on account of which such intimate photographs have been supplied by the informant to the police for making it part of the case. It is next submitted that the allegations against the petitioners are general and omnibus in nature and they have been implicated in the case only with a view to coerce Azad Ansari into submission. It is further submitted that even presuming what has been alleged is true without admitting then the thrust of the allegation is against Azad Ansari.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
