The petitioner seeks bail in a case under section 302/34 of the Indian Penal Code and section 27 of the Arms Act. The informant stated in the F.I.R. that he heard that Rajnish Ranjan Kumar @ Pappu, younger brother of the owner of Satyam Private I.T.I. School, was killed inside the campus of the school. The informant went there and saw the body of Rajnish Ranjan in a pool of blood. The informant suspected that Manoj Yadav and others might have killed the deceased only because Manoj Yadav had some altercation for non-supply of water for irrigation of his land.
It is submitted that except suspicion, there is no
Patna High Court Cr.Misc. No.19967 of 2015 (2) dt.17-06-2015 material against the petitioner.
Learned counsel for the informant, on the other hand, vehemently opposed the prayer for bail and submitted that services of snuffer dog was taken. Snuffer dog went to the house of the petitioner and Manoj Yadav from where one live cartridge was recovered but it appears that the very recovery of empty cartridge from the joint house of the petitioner does not show the involvement of the petitioner in the killing of the deceased. Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No. 03 of 2015.
