====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 19-02-2025 Heard Mr. Brij Kishor Mishra, learned counsel appearing on behalf of the petitioners and Mr. Pradeep Narain Kumar, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Nautan P.S. Case No. 359 of 2024, registered for the offence punishable under Sections 30(a) and 45 of the Bihar Prohibition and Excise Act as amended up-to-date.

3. As per the allegation made in the FIR, while raid was being conducted by the police officials, the petitioners along with the accused persons named in the FIR and some unknown accused persons, had obstructed the police officials from discharging their duty and had also assaulted them. 4.77 litres of illicit liquor was recovered from one co-accused, namely, Chandeshwar Singh.
4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. General and omnibus allegation has been levelled against the petitioner. 4.77 litres of illicit liquor was recovered from one co-accused, namely, Chandeshwar Singh. Petitioners have clean antecedent. On these grounds, petitioners seek to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Considering the facts and circumstances of the case, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty

No.4634 of 2025(2) dt.19-02-2025 3/3 Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 359 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
7. The learned District Court is directed to verify the criminal antecedent of the petitioners as stated in paragraph no. 3 of the bail application.
