The petitioner is accused in connection with Khagaria (Muffasil) P.S. Case No. 635 of 2015, registered under Section 25(1-b)a and 26 of the Arms Act.
The accusation is of recovery of one country made pistol along with 14 live cartridges from the possession of the petitioner.
Learned counsel for the petitioner submits that while it is alleged by the informant that one country made pistol along with 14 live cartridges recovered from the possession of the petitioner, but the seizure-list would indicate that the same was recovered by the Police on the way near Karu Baba Asthan, as detailed in Column No. 02 of the seizure list. Further
Patna High Court Cr.Misc. No.19559 of 2016 (2) dt.09-05-2016 2/2 submission is that, in fact, petitioner is accused in five cases in which he is on bail and due to that reason Police got implicated the petitioner in the present case showing recovery of a country made pistol and 14 live cartridges. Further submission is that petitioner is in custody since 27.09.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 635 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
