JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2019 This application, for grant of anticipatory bail, arises out of Khagaria (Muffasil) P.S. Case No. 530 of 2018, disclosing offences under Sections 302, 120B and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that the Informant received information that the accused persons have shot dead his sister and her two daughters, on which, the informant went there and found the dead body of her sister and her two daughters. Submission of learned counsel for the petitioner is that several witnesses have stated that on hulla, they went there and saw the pistol in the hand of husband of the deceased Puja Devi and the dead body of Puja Devi and her two daughters. Further in para 61 and 63 of the case diary, it appears that independent witnesses have disclosed that petitioner and others

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate -1st Class, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 530 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
